Terms & Conditions

By Purchasing an Audio Sugar License you have full access to all Audio sugar assets within the royalty free music and sound effects library.

Once you become a license holder your audio remains licensed for the life of your project.

License holders are permitted to reasonable download activity which is classified as “up to 30 downloads per day”. Activity that shows excess of 30 downloads per day may be flagged as software and/or bots and is strictly prohibited.

The purpose of Audio sugar is for the videographer and content creator. When creating projects under the Audio Sugar Licence you are covered for the “use” of the Audio Sugar assets and not the “ownership” of the Audio assets. The audio assets can only be used for your video projects and not stand alone items like streaming audio or more of the like.

Example, The user is not permitted to create playlist or loop style videos that stream as an audio asset. The license covers the use of Audio sugar assets for film based content and projects by a videographer.

The following are not permitted as licensed use for Audio Sugar assets:

Music streaming, music channels, radio, other ways of music or sound effects reproduction.`

The creation of a static video, a video loop animation combined with music in the background or lyric video is also forbidden.

The license holder can not allow themselves or others to use the Assets as individual or separate files for streaming, listening or downloading.

In is strictly prohibited for Audio Sugar license holders to resell Audio Sugar Assets.

Audio Sugar assets can not be used in any manner that is deemed illegal, contrary to court orders and/or which was forbidden by the provisions of any law.

The Assets cannot be used: :info: in the context of pornography; or (ii) to encourage violence abomination, racism, hate, threats and discrimination against any person based on race, religion, sex, sexual orientation, community or nationality, (iii) hurting the helpless; (iv) violating privacy; (v) slander and any other insulting or illegal contents.

We reserve to ourselves the right to assess case by case scenarios whether a certain use of an Asset is considered a violation of the above. By accepting the terms and conditions of an Audio sugar license holder you undertake to accept our decision in these matters.

In the case where there is a a violation between Audio Sugar and a third party with relation to an asset we reserve the right to inform you to remove the asset from the public market place. While this is an extreme rarity we understand that things can happen and the procedure is to be followed.

As a “user” and not “owner” of the assets the license holder is not permitted to register or claim ownership of the Assets or the Projects (or otherwise make it available) through any content detection and/or registration system, such as YouTube’s Content ID (CID), Facebook Rights Manager, etc.

TERMS OF USE

These Terms of Use (“Terms”) settles the terms and conditions under which you may access and use this website and/or application and/or other future platforms offered by Company (“Site”), which is provided and made available to you by Audio Sugar Pty Ltd and its affiliates (“Company”, “Audio Sugar”, “we”, “our”, “us”).

Please note that by accessing using the Site, you, your authorised representative and/or any entity you hereby represent (“you”, “your”) accept these Terms and the Privacy Policy and agree to be bound by them. Therefore, it is your obligation to read these Terms and the Privacy Policy carefully and make sure you agree with them before any access or use of the site.

Please be advised that by subscribing to our services, you will also be subject to the relevant Licensehttps://artlist.io/help-center/privacy-terms/artlist-licensewhich applies to the specific subscription and assets you purchased (“License”), which shall be read together with these Terms and the Privacy Policy (together the “Agreement”). Capitalised terms used but not defined herein, shall have the respective meanings given to them in the License.

You hereby represent and warrant that:

you have read the Agreement, understood the stated therein and you hereby agree to engage with the Company under its terms;
your age does not limit you from lawfully engaging in the Agreement and that you are not legally prohibited from entering into the Agreement;
you are authorised to enter into and perform the Agreement for yourself or for the entity the details of which were specified upon subscription to our services.

(A) Opening an account

To become a license holder with Audio Sugar Pty Ltd and to use the Assets as specified in these Terms and in the License, you are required to open an account in the Site.

This means providing us with your accurate and full details, including your Channels URL’s and paying any applicable fees.

Fees are applicable unless in case of a free trial account but the inclusion of your payment method ( Credit card details) will be necessary to complete the user account.

You are forbidden from providing us a nonexistent email address or an email address which does not belong to you, impersonating another person or entity, or misleading us in any other way regarding your identity or your payment method information.

You are required to protect the confidentiality and safety of the account details (username and password), and you will bear full and exclusive liability for all activities in your account. You must inform us immediately of any unauthorised use of your account

(B) Refund Policy

As the user you have the right request a refund under the following conditions.

you cancel your subscription within 14 calendar days from the date of its purchase and/or renewal (“Refund Period”)

and you did not download any Assets during such Refund Period.

All the information, the Assets and contents included in the Site and the services offered by the Company, inclusive without limitation of any text, illustrations, graphics, sound, sound recording, musical works, clips, graphic segments, software applications, graphs, photos, video templates, plugins, Company’s name, trademarks and logos, including without limitation those used in the Site, are protected by copyrights and intellectual property rights of the Company or of its artists (“Proprietary Content”).

You are forbidden from using the Company’s name, trademarks and logos, including without limitation those used in the Site. Moreover, as further specified in the License, you are forbidden from using the original Assets names and/or the artists names or artistic names.

You hereby acknowledge and confirm that you do not and will not have any ownership and/or intellectual property rights in the Proprietary Content and/or recordings and/or the Assets and/or the contents of the Site and/or the Site’s trademarks and its design, and that your right is restricted to the limited rights granted to you in these Terms and in the License.

The Agreement grants you an authorisation to use the Site and the Assets strictly in accordance with the provisions of the Agreement and is conditioned by your undertaking not to violate or be involved in any activities that violate any terms of the Agreement, and specifically in activities which cause the violation of intellectual property rights and/or deviation from the provisions of the License.

You may not reverse engineer, decompile, or disassemble any part of any source code contained within the Site, or any of the Proprietary Content, including the video templates and plugins or avoid, bypass, remove or impair any technological measure that limits access to them.
